In caseù one of the spouses refuses the divorce, Tunisian law has provided for the possibility of for the spouse who wishes to ask for a divorce by will; unilateral. The judge declares the divorce and grants the party refusing the divorce rights such as compensatory allowance, alimony, child custody, damages, division of property real estate and the authority parental.
